Terms and conditions

SCOPE OF APPLICATION

All sales contracts and deliveries based on orders from our customers via our online shop at www.rave-wear.shop ("Webshop") are subject to these General Terms and Conditions in the version valid at the time of the order.

CONCLUSION OF CONTRACT

(1) The contract between the customer and Kathol GmbH ("Rave Wear") is concluded through offer and acceptance. The customer submits the offer, and Rave Wear accepts the offer. The contract is concluded as described in paragraphs 2 and 3.

(2) The customer can select products from the web shop and collect them using the "Add to shopping cart" button. By clicking on the "Buy" button, the customer makes a binding offer to purchase the goods in the shopping cart. Before the final confirmation of the purchase, the customer can change and view the data at any time. A purchase is only possible if the customer has previously agreed to the General Terms and Conditions.

 

(3) Rave Wear sends the customer an automatic acknowledgment of receipt by e-mail, in which the customer's order is listed and which the customer can print out using the "Print" function. The automatic acknowledgment of receipt only documents that the customer's order has been received by the provider and does not constitute acceptance. The contract only comes into effect through our declaration of acceptance, which is sent in a separate email.

TERMS OF PAYMENT

(1) The customer is offered various payment methods (payment by credit card, PayPal or prepayment). We treat your data confidentially. You can find details on this in our data protection information.

 

(2) In the case of prepayment, the amount stated in the e-mail confirming receipt must be credited to the account specified by Rave Wear within seven working days, otherwise the order will be cancelled.

 

(3) Payments via Klarna

In cooperation with Klarna AB (publ), Sveavägen 46, S-11134 Stockholm we offer the following payment options. Payment is made to Klarna in each case:

  • Invoice: The payment period is 14 days from dispatch of the goods/ticket/or, in the case of other services, the provision of the service. The complete terms and conditions for purchase on account for deliveries to Germany and Austria can be found here.

  • Installment purchase (only available for Germany): With Klarna's financing service, you can flexibly pay for your purchase in monthly installments of at least 1/24 of the total amount (but at least EUR 6.95) or under the conditions otherwise specified in the checkout. The installment payment is due at the end of the month after Klarna has sent a monthly invoice.   • Immediately: Your account will be debited immediately after placing the order.

  • Credit card (Visa/ Mastercard)

  • Direct debit: The debit takes place after the goods have been dispatched. You will be informed of the time by email.

 

The use of the payment methods invoice, installment purchase and direct debit requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and creditworthiness checks as part of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permissible based on the results of the credit check.  Your personal information will be treated in accordance with the applicable data protection regulations and in accordance with the information in Klarna's data protection regulations.

Klarna Checkout is available in: Sweden, Finland, Denmark, Germany, Austria, and the Netherlands.

Klarna's individual payment methods are available in: Sweden, Finland, Denmark, Germany, Austria, the Netherlands, Belgium, France, Italy, Poland, Spain, Portugal, Hungary, Czech Republic and Slovakia.

Shipping and Returns

Shipping costs are 5,99€ per order; free shipping applies for orders higher than 70€. We usually only ship to countries inside the EU. If you are located outside the EU and really want our stuff, please contact us regarding individual quotes.

Any claims for misprinted/damaged/defective items must be submitted within 30 days after the product has been received. For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

If you notice an issue on the products or anything else on the order, please submit a problem report.

Before returning your goods please contact us in order to send you the correct returning address. When we receive a returned shipment, an email notification will be sent to you. Unclaimed returns get donated to charity after 30 days.

Wrong Address - If you provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable).

​

Unclaimed - Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to yourself or your end customer (if and as applicable).

​

Unfortunately currently we cannot offer you to refund orders on your’s remorse. Returns for products, as well as size exchanges have to be offered individual at your expense and discretion. Please contact us if you are not happy with the order and we will try to find a good solution for you! 

 

Notification for EU consumers: According to Article 16(c) and (e) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for the supply of goods that are made to the consumer's specifications or are clearly personalized.

This Policy shall be governed and interpreted in accordance with the English language, regardless of any translations made for any purpose whatsoever.

RETENTION OF TITLE

The goods remain the property of Rave Wear until full payment has been made.

WARRANTY

(1) The statutory provisions apply.

(2) There is only a guarantee for the goods delivered by us if one has been expressly given; the statutory warranty claims remain unaffected by a guarantee.

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a third party named by you who is not the carrier took possession of the last goods. In order to exercise your right of withdrawal, you must send us an a clear statement (e.g. a letter sent by post, a phone call, a fax or an e-mail) about your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired. Consequences of the revocation: If you revoke this contract, we have to return you all payments which we have received from you, excluding the delivery costs (if already shipped) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier. You have to return the goods to Rave Wear, immediately and in any event not later than fourteen days from the day on which you inform us of the cancellation of this contract hand over. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Exceptions to your right of withdrawal You are not entitled to a statutory right of withdrawal for contracts relating to: (a) the supply of goods made to your specifications or clearly tailored to personal needs; and or (b) the delivery of goods which are not suitable for return for reasons of health protection or hygiene and the seal of which has been removed after delivery. - End of revocation -

COMPLAINTS PROCEDURE

The European Commission provides a platform for online dispute resolution (OS). This can be accessed via the following link: http://ec.europa.eu/consumers/odr/. We are willing to participate in an out-of-court arbitration process.
